The Online Shop at DAIKINILINGERIE.com is a service of CRAFTIFY Ltd. provided solely for customers’ personal use for the sale of lingerie, accessories, and other items. Access to and use of this Website and the products and services available through this Website are subject to the following terms, conditions, and notices.

To be eligible to purchase items on this Website, customers must:

Be the holder of a valid debit/credit card.
Warrant that the personal information, which customers are required to provide when placing an order, is true, accurate, and current in all respects.

Customers agree not to impersonate any other person or entity or to use a false name or a name that the customer is not authorized to use. By using this site, customers agree to comply with, and be bound by, these Terms. DAIKINILINGERIE may from time to time change these Terms at its sole discretion. By using this Website after any such change(s), customers agree to comply with, and be bound by, the Terms as changed.

Making A Purchase

When a customer orders an item from DAIKINILINGERIE, the customer is offering to buy it for the price stated, subject to these Terms. The customer will be guided through the process of placing an order by a series of instructions on the Website. The customer places an order for items from the Website by completing the online order process. Once a customer has placed an order, they will receive an email from DAIKINILINGERIE, acknowledging the exact details of the order.

Unless DAIKINILINGERIE notifies the customer that their order has not been accepted, or the customer has canceled their order, DAIKINILINGERIE’s acceptance of the customer’s order and the completion of the contract between the customer and DAIKINILINGERIE will take place when the customer receives an email from DAIKINILINGERIE confirming the items they have ordered.

DAIKINILINGERIE’s acceptance of the customer’s order will be deemed complete and received by the customer at the time and date of sending of the email, which time and date is specified on the email. The deemed time and date of receipt by the customer shall apply regardless of whether, for reasons outside DAIKINILINGERIE’s control, the customer has not received that email.

DAIKINILINGERIE may not accept a customer’s order if:

An item the customer has ordered is out of stock,
DAIKINILINGERIE is unable to obtain authorization for the customer’s payment, or
If DAIKINILINGERIE identifies a product or pricing error. DAIKINILINGERIE reserves the right to reject any offer to purchase by a customer at any time and at the sole discretion of DAIKINILINGERIE.

If DAIKINILINGERIE is unable to fulfill a customer’s order following DAIKINILINGERIE’s order acknowledgment, DAIKINILINGERIE will contact the customer by email advising them of this.

DAIKINILINGERIE will try to keep its Website as up-to-date as reasonably possible but cannot guarantee that any particular item will always be available. If DAIKINILINGERIE can’t supply any item it will release the funds being held in the customer’s account for the purchase.

In addition, DAIKINILINGERIE has taken great care to ensure that the items on its website are presented as accurately as possible. However, color clarity will depend upon customers’ own personal monitors and DAIKINILINGERIE therefore cannot guarantee that the color represented by the customer’s device or monitor is absolutely accurate.

Pricing

All prices indicated for items for which designers use DAIKINILINGERIE as a transaction platform are inclusive of the respective taxes of the country the designer is based in.

Coupon Discounts

Discounts may be offered to selected customers at DAIKINILINGERIE’s complete discretion. Discount privileges may be withdrawn at any time in relation to any order that has not been acknowledged.

Payments

DAIKINILINGERIE takes all reasonable care to make its Site secure. DAIKINILINGERIE does not store customers’ credit card details on its systems, however, all other details will be fully encrypted and only used to process the order which the customer has initiated. Furthermore, DAIKINILINGERIE will take all reasonable care, in so far as it is in its power to do so, to keep the details of customers’ orders and payments secure, but in the absence of negligence on DAIKINILINGERIE’s part, DAIKINILINGERIE cannot be held liable for any loss the customer may suffer if a third party procures unauthorized access to any data the customer provides when accessing or ordering from the Site.

Credit Cards

The customer’s credit card company may undertake an additional security check to confirm it is the customer making the order. DAIKINILINGERIE or its designers will retain the legal ownership of the items until full payment has been made by the customer, and such payment has been received by DAIKINILINGERIE. Legal ownership of the items will immediately revert to DAIKINILINGERIE or its designers if it refunds any such payment to the customer. Risk in the items will pass to the customer on delivery to them.

Shipments

DAIKINILINGERIE and its designers aim to deliver the customer’s chosen items to the place and person of their choice, in perfect condition and in the shortest possible time. Your order will come directly from the designer’s studio. The designers provide delivery methods that are subject to a thorough quality control process by DAIKINILINGERIE in order to ensure complete customer satisfaction.

Please order from DAIKINILINGERIE with enough lead-time to prevent any loss or disappointment resulting from the delivery time, as DAIKINILINGERIE cannot be responsible for this.

The default processing time frame for In Stock items is usually between 3 and 5 working days. Individual brands may have different processing times. Please check each individual item for more information. For Made to Order items, the processing times can vary between 2-4 weeks.

The delivery times are dependent on when the order is processed and on the designer’s and customer’s location. DAIKINILINGERIE operates Monday to Friday excluding UK public holidays and orders are not processed outside of this time frame. Estimated delivery times are to be used as a guide only and commence from the date the order is processed. DAIKINILINGERIE and its designers are not responsible for any delays caused by any local customs clearance processes. If the customer’s order cannot be delivered within the timeframe specified at the time the order is placed, DAIKINILINGERIE will notify the customer and try to rectify the situation as quickly as is practically possible. All new orders are deemed separate and each is treated individually.

Dispatch

Please note that DAIKINILINGERIE and its designers aim to dispatch all orders within 5 working days, excluding bank holidays. DAIKINILINGERIE and its designers are not responsible for any delays caused by any local customs clearance processes. Taking into account that all items are delivered directly from the designers, if a customer has multiple items within their order, these items may be delivered at different times.

Tax & Duties

If the customer orders goods for delivery outside of the EU or purchases items from a designer based outside of their country or trading zone, please note that the customer’s purchase may be subject to import duties and taxes, which are levied once the goods reach the country of destination. Any such charges levied in relation to customs clearance must be borne by the customer. It is accepted by the customer that DAIKINILINGERIE or its designers have no control over additional charges in relation to customs clearance. DAIKINILINGERIE recommends that the customer checks with their local customs officials or post office for more information regarding importation taxes/duties that may be applicable to their online order.

Insurance

DAIKINILINGERIE and its designers insure each purchase during the time it is in transit until it is delivered to the customer’s specified delivery address. DAIKINILINGERIE requires a signature for any goods delivered, at which point responsibility for the customer’s purchased goods passes to the customer. If the customer has specified a recipient who is not themselves for delivery purposes (for example as a gift) then the customer accepts that evidence of a signature by this recipient (or at that delivery address) is evidence of delivery and fulfillment by DAIKINILINGERIE and transfer of responsibility in the same way.

Force Majeure

DAIKINILINGERIE and its designers shall have no liability to the customer for any failure to deliver goods they have ordered or any delay in doing so or for any damage or defect to goods delivered that is caused by any event or circumstance beyond its reasonable control.

Copyright & Trademarks

All content available on the Website, including, but not limited to, text, graphics, logos, button, icons, images, audio clips, data compilations, and software, and the compilation thereof (the “Content”) is the property of CRAFTIFY Ltd., its designers, its partners or its licensors, and is protected by international copyright laws.

The trademarks, logos, and service marks displayed on the Website (collectively, the “Trademarks”) are the registered and unregistered marks of CRAFTIFY Ltd., its designers, its licensors or its partners and are protected by international trademark laws. All or any other trademarks not owned by CRAFTIFY Ltd., its affiliates, its partners or its licensors that appear on the Website are the property of their respective owners, who may or may not be affiliated with, connected to, or sponsored by CRAFTIFY Ltd.

Neither the Content, the Trademarks, nor any other portion of the Website may be used, reproduced, duplicated, copied, sold, resold, accessed, modified, or otherwise exploited, in full or in part, for any purpose without CRAFTIFY Ltd.’s prior written consent.

Entire Agreement

These terms and conditions, together with the current DAIKINILINGERIE website prices, delivery details and DAIKINILINGERIE contact details, set out the whole of the agreement relating to the supply of the goods to customers by DAIKINILINGERIE. These terms and conditions cannot be varied except in writing signed by a director of DAIKINILINGERIE.

Governing Law

Customers’ use of this Website and any purchase by them of any item from DAIKINILINGERIE shall be governed by Bulgarian law and the customer hereto submits to the exclusive jurisdiction of the Bulgarian courts.
